These terms govern your use of Caliq. By downloading or using the app, you agree to these terms.

Agreement to terms

By accessing or using Caliq ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms apply to all users of the App, regardless of subscription tier.

License to use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Caliq for your personal, non-commercial use.

You may not:

  • Modify, reverse engineer, decompile, or disassemble the App
  • Copy, distribute, or create derivative works from the App
  • Use the App for any illegal or unauthorized purpose
  • Remove or alter any copyright, trademark, or proprietary notices
  • Attempt to gain unauthorized access to any portion of the App
  • Use the App in a way that could damage, disable, or impair our services
  • Use automated systems or software to extract data from the App

Subscriptions and payments

Caliq offers auto-renewing subscription plans managed entirely through Apple's In-App Purchase system:

  • Personal: $0.99 per month
  • Professional: $4.99 per month

Subscription terms

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your Apple Account settings
  • Any unused portion of a free trial period will be forfeited when you purchase a subscription

Free trials

Some subscription tiers may offer a free trial period. If you do not cancel before the trial period ends, you may be automatically charged for the subscription.

Refunds

All purchases are processed through Apple. Refund requests must be directed to Apple through your App Store account. We do not have access to process refunds directly.

Price changes

We reserve the right to change subscription prices at any time. Price changes for existing subscribers will take effect at the start of the next subscription period following notice of the change.

User responsibilities

You are responsible for:

  • Maintaining the security of your device and Apple ID
  • All activity that occurs under your account
  • Ensuring your use of the App complies with applicable laws
  • The accuracy and legality of any content you input into the App
  • Backing up your data using iOS backup systems
  • Maintaining an internet connection for features that require connectivity

Intellectual property

The App and all content, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by Tridib Banerjee and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you create using the App (such as notes and calendar events). We do not claim ownership of your content.

Third-party services

The App may integrate with or rely on third-party services, including:

  • Apple Calendar (EventKit framework)
  • Apple In-App Purchase
  • iCloud synchronization
  • OpenAI (for optional online parsing)
  • Cloudflare (for content delivery and security)
  • GitHub (for weblink hosting)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of third-party service providers.

Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The App or servers are free of viruses or harmful components
  • Results from using the App will meet your expectations
  • Calendar events will be created without errors
  • Online parsing will always be accurate or available

You use the App at your own risk. We recommend verifying all calendar events before relying on them.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRIDIB BANERJEE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the App
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or similar issues transmitted through the App
  • Any errors or omissions in any content
  • Any missed appointments or scheduling errors
  • Loss of data due to device failure or any other cause

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

Indemnification

You agree to defend, indemnify, and hold harmless Tridib Banerjee from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit through the App

Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

You may terminate your use of the App at any time by:

  • Canceling your subscription through your Apple Account settings
  • Deleting the App from your device

Upon termination, your right to use the App will immediately cease. Termination does not automatically cancel your subscription; you must cancel through Apple separately.

Changes to these terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of these Terms and, where appropriate, through the App or via email.

Your continued use of the App after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of the European Union and Germany, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through good faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts in Germany.

Severability and waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tridib Banerjee regarding the App and supersede all prior agreements and understandings, whether written or oral.
